Inspector Ram Niwas Submits That The Muds Details Of Which Are Mentioned In Page No. 3 To 5 (total Vehicles 111) Of The Applications Are Impounded Under Sec 207 Mv Act And Are Lying In Patel Nagar Traffic Circle For More Than Last 6 Years. The Hon'ble High Court Of Delhi In Manjeet Singh Vs State (crl. M.c. 4485/2013 And Crl. Ma No. 16055/2013) Has Observed In Para 73 That "if A Vehicle Is Not Claimed By The Accused, Owner Of The Insurance Company Or By A Third Person, It May Be Ordered To Be Sold By Auction". In View Of The Submissions Given By Inspector Ram Niwas That No One Has Appeared To Claim The Ownership Of The Seized Muds As Mentioned In Page No. 3 To 5 Of The Application And Also In View Of The Aforesaid Judgment Of The Hon'ble High Court Of Delhi, The Application Filed By Inspector Ram Niwas Is Allowed Subject To The Condition That The Seized Muds May Be Sold By Auction/disposed Off As Per Rules And The Money Realised If Any Be Deposited In The Government Treasury And Considering The Submission Of The Ti, Challan Mentioned From The Serial No. 1 To 111 In List Of Vehicles Amend With The Applications Are Dismissed As Withdrawn. Application Stands Disposed Off. Thus, On The Request Of Ti/karolbagh And Incompliance To The Above Directions Of Honble Court, This Office Is Placed The Property Herein For Auction. |
